Changes to the 30% ruling
- the requirement of 'special skills' must meet a standard (minimum) salary;
- the discount rules will be extended to 25 years (the current discount scheme is 10 - 15 years), allowing more periods of previous residence or employment in the Netherlands te be deducted from the duration of the 30% ruling;
- employees living in a radius of 150 km from the Dutch border will be considered not to have been recruited from abroad, thus being no longer entitled to the 30% ruling;
- the 30% ruling will be available to young PhD students, with a lower minimum salary criterion.
As of July 1, 2011 the administrative fees to obtain a residence permit (without Entry Visa) for Highly Skilled Migrants was raised from €331,- to €750,-. Further information on legal fees can be found on the website of the IND.
M-46 form no longer required for Highly Skilled Migrants
European Blue Card as of June 19, 2011
The European Blue Card, as a new reason of stay in the Netherlands, is meant for Highly Skilled Migrants from outside the EU, EER or Switzerland, wishing to work in one of these countries. With the Blue Card, it will be easier to switch for work (and residence) from one European Country to another. The requirements for this Blue Card are increased compared to the regular Highly Skilled Migrant procedure requirements. Implementation of the Modern Migration (MoMi) law postponed.
The new MoMi immigration law, which was to be introduced January 1, 2011, will not be operational as was planned. Reason for the postponement is the delay in the implementation of a new computer system at the IND. The new introduction date of the MoMi law is not yet known.
Until that time, all pilot projects to gain experience with the MoMi application procedures will be continued and/or expanded. (source: www.ind.nl)
Higher fees for return visa application
As per January 15, 2011 the fees for a return visa for the Netherlands have been raised from € 40 to €140. For more information on legal fees, please check the website of the IND.
